Terms of Service
These terms are a contract between you and Heluva, Ho Chi Minh City, Vietnam (“we”), for the Family Locator app at app.familylocator.co and this website. By creating an account you accept them. How we handle your data is described in the Privacy Policy.
1. What Family Locator is
Family Locator lets people who have agreed to share their location see each other on a map, with places, arrival alerts, check-ins, low-battery alerts, SOS and location history. It is a consent-based tool: it does not, and is not designed to, locate a person who has not accepted an invite from their own phone.
2. Your account
- You must be at least 16 to create an account. Accounts for younger family members are set up and consented to by a parent or guardian as described in the app.
- You are responsible for the phone number and device linked to your account. Tell us at support@familylocator.co if you lose access.
- One account per person. Do not create an account on someone else’s behalf without their knowledge and agreement.
3. Acceptable use
You may not use Family Locator to:
- attempt to see the location of a person who has not accepted your invite, or pressure someone into accepting;
- install or keep the app on a device you do not own without the informed agreement of the person who uses it;
- harass, stalk, threaten or endanger anyone;
- break the law, interfere with the service, or try to access other people’s data.
We may suspend or close accounts that break these rules, and we cooperate with law enforcement where the law requires it.
4. Consent and control
Every member of a circle can see who can see them, can pause or stop sharing at any time, and can leave a circle. Doing so is never a breach of these terms. If someone stops sharing with you, the app tells you; it does not tell you why.
5. Paid plans
- Some features are part of paid plans. What each plan includes and what it costs are shown in the app before you buy. SOS is included on every plan.
- Paid plans are billed through the App Store, Google Play or the payment provider shown in the app and renew automatically until cancelled. Cancel at any time in that store or in the app; access continues to the end of the paid period.
- Refunds follow the rules of the store or provider you paid through, and any consumer rights that apply where you live.
6. Location accuracy and availability
Positions come from the phone’s own GPS, Wi-Fi and cell signals and can be delayed, imprecise or unavailable, for example indoors, when a battery is flat, when the phone is offline, or when the operating system limits background activity. Family Locator is not an emergency service. In an emergency call your local emergency number; SOS notifies your circle, it does not call the authorities.
7. Your content
Names, photos, place names and check-in notes you add stay yours. You give us the permission needed to show them to the people you share with and to run the service.
8. Ending the agreement
You can delete your account at any time (see Delete account). We may end the agreement with reasonable notice, or immediately if you break section 3.
9. Liability
We provide Family Locator with reasonable skill and care. To the extent the law allows, we are not liable for loss caused by inaccurate or unavailable location data, by other users, or by events outside our control, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Governing law and changes
These terms are governed by the law of Vietnam, without affecting mandatory consumer protections where you live. When we change these terms in a way that matters, we tell you in the app before the change takes effect.
